Precedental law

Considerated from the aspect of the sources, laws are devited into two main categories according to the solemnity of the form in which they are made : written or unwritten. Written law signifies any law that is formaly enacted and the unwritten law signifies all unenacted law.
The volume of written law tends the volume of unritten, as many continental countries chave codified much of their law. But unwritten law in England is predominant. Some of the law is codified in England as well: Sales of Good and partnership Acts can be mentioned.Two principal and two subsidiary sources of English law can be mentioned: Pr S: Legislation and Judicial Precedent. SUB S: Customs and Books of Authority.
Legislation is enacted law. The ultimate legislater in England is Parlament. The Parlament is sovereign. The doctrin of parliamentary sovereignity first of all means that all legislation power within realm is vested in Parl, or is derived from the authority of Parl (parl has no rival within the legislative sphere). Secondly it means that there is no limit to the power of Parl. In legislative sphere the Parlament is master but it does not mean that courts have no influence upon the development of enacted law. Every enactment has to be interpreted before applying it and courts are recognized interpreters of the law.
Precedents – desicions of courts which subsequent courts will follow when they are colled upon to determine issues of a similar kind. The approach of legal decision in on one hand inductive on common law and on the other hand deductive in the civil law, in reality the two systems are not so divergent as might appear.
